A G R E E M E N T dated this 6th day of January, 1982
B E T W E E N:

THE TIMISKAMING BOARD OF EDUCATION,

hereinafter called " the Board"
- and -

THE TOWN OF ENGLEHART,
hereinafter called "the Town".

THE BOARD AND THE TOWN AGREE AS FOLLOWS:

1. This Agreement shall be read and interpreted in conjunction with the Board's policy on the USE OF SCHOOLS, dated December 14, 1981, and the Town's policy respecting USE OF RECREATIONAL FACILITIES, copies of which are attached hereto and form part of this agreement.

2. The Board shall make available to the Town without charge the facilities of the Board for use by the Town for recreational purposes, when such use does not, in the opinion of the principal of the particular school in which the facilities exist, interfere with
the normal use of the facilities by the Board in pursuance of its educative function.

3. The Town shall make available to the Board without charge the use of community owned facilities so long as such use does not interfere with the regular community use of these facilities.

4. The Board and the Town will consult with each other in relation to the use of present and future school buildings, recreation centres and park lands.

5. Both parties are responsible for the maintenance of their own respective buildings; however, each party is responsible for making good any damages occurring in these facilities during use by the said Party.

6. The staffs of the Board and the Town shall consult and co-operate with each other where applicable in the planning of programs of recreation and leisure activities, and will make their own arrangements with regard to the use of each other's equipment.

7. A working committee shall be formed of two staff members of the Board and two Council representatives of the Town; such a committee to be responsible only for liaison and co-ordination in the use of both Community and Board facilities.

8. The Board and the Municipality shall at all times maintain liability insurance which shall cover all loss or damage incurred by any person or persons as a result of the use of the other party's facilities. The parties further agree that each shall indemnify and save harmless the other from and against any and all claims by or on behalf of any person or persons arising from the usage of the other party's facilities through the negligence or other act or omission of the party using the facilities, its agents,
servants, employees, licencees or invitees.

9. This agreement shall terminate:

(a) On the breach of any term hereof, by either party, at the option of the other party.
(b) On the expiration of 90 days from the mailing by prepaid ordinary mail of a notice by either party of its intention so to terminate this agreement.
(c) On the expiration of 5 years from the date hereof, unless in the meantime renewed for a further period.

The Board will notify the Town prior to expiration of this agreement with a view to its renewal.
