The Act serves to amalgamate the Environmental Assessment Board and the Environmental Appeal Board. The Tribunal is composed of not fewer than five persons appointed by the Lieutenant Governor in Council.
The Environmental Review Tribunal functions as a quasi-judicial tribunal whose primary role is to make judgements on applications under the following legislation:
- Environmental Assessment Act
- Environmental Protection Act
- Clean Water Act, 2006
- Ontario Water Resources Act
- Pesticides Act
- Niagara Escarpment Planning and Development Act
- Consolidated Hearings Act
- Environmental Bill of Rights, 1993
- Nutrient Management Act, 2002
- Greenbelt Act, 2005
- Oak Ridges Moraine Conservation Act, 2001.
The tribunal provides both an independent and impartial review of the decisions of directors appointed by the Minister of the Environment and
the decisions of the Niagara Escarpment Commission, as well as a fair
and unbiased public hearing process which assesses the merits of
proposed development projects, plans or programs that will have an
impact on the environment.
